Advice to passengers on limitation of liability.
EU Notice Requirement. Notice/Advice to passengers on limitation of liability. If your journey involves an ultimate destination or stop in a country other than the one from which you depart, the Warsaw Convention or the Montreal Convention may be applicable and those Conventions govern and may limit the liability of carriers for death or bodily injury, loss of or damage to baggage, and for delay. Where the Montreal Convention applies, the carrier is liable for proven damages for death or bodily injury without financial limit, except that the carrier will not be liable to the extent that such damages exceed for each passenger the national currency equivalent of 100,000 SDRs if the carrier proves certain defenses specified by that Convention. The Montreal Convention non-limit, and 100,000 SDRs limit, of liability applies to carriage undertaken by Ghana International Airlines, Ltd..  Where the Montreal Convention does not apply, it is the case that many air carriers have waived the Warsaw Convention limits for death or bodily injury and, to the extent damages do not exceed 100,000 SDRs, the defense that they have taken all necessary measures to avoid the damage.  Where no such waiver provisions are included in a carrier’s conditions of carriage please note that:  (i) for such passengers on a journey to, from or with an agreed stopping place in the United States of America, the Warsaw Convention and special contracts of carriage embodied in applicable tariffs provide that the liability of certain carriers, parties to such special contracts, for death or personal injury to passengers is limited in most cases to proven damages not to exceed US$75,000 per passenger, and that this liability up to such limit shall not depend on negligence on the part of the carrier; and (ii) for such passengers traveling by a carrier not a party to such special contracts or on a journey to which the Warsaw Convention applies which is not to, from or having an agreed stopping place in the United States of America, the liability of the carrier for death or personal injury to passengers is limited in most cases to approximately US$10,000 or US$20,000. The names of carriers party to special contracts of the type mentioned in (i) above are available at all ticket offices of such carriers and may be examined on request. Additional protection can usually be obtained by purchasing insurance from a private company. Such insurance is not affected by any limitation of the carrier’s liability under the Warsaw Convention or the Montreal Convention or such special contracts of carriage. For further information, please consult your airline or insurance company representatives. NOTE: The limit of liability of US $75,000 specified in (i) above is inclusive of legal fees and costs except that in case of a claim brought in a US state where a provision is made for separate award of legal fees and costs, the limit shall be the sum of US $58,000 exclusive of legal fees and costs. Notice of baggage liability limitations. For most international travel (including domestic portions of international journeys) liability for loss, delay, or damage to baggage is limited by the Warsaw Convention or the Montreal Convention. Where the Montreal Convention applies, such liability is limited to a maximum of 1,000 SDRs per passenger for checked and unchecked baggage.  The Montreal Convention limit of liability applies to carriage undertaken by Ghana International Airlines, Ltd..  Where the Warsaw Convention applies, liability is limited to 17 SDRs per kilo (approximately US $20.00 per kilo) for checked baggage and 350 SDRs (approximately US$ 500.00) per passenger for unchecked baggage.  For travel wholly between U.S. points, Federal rules require any limit on an airline’s baggage liability to be at least US $2,500 per passenger. Where baggage is greater in value than the applicable limit of liability, the passenger may benefit from a higher limit by making a special declaration and paying a supplementary fee.  Alternatively, the passenger should ensure that his/her baggage is fully insured.  Excess valuation may not be declared on certain types of articles. Some carriers assume no liability for fragile, valuable or perishable articles. Further information may be obtained from the carrier. Notice of liability for delay limitations. For most international travel (including domestic portions of international journeys) liability for damage occasioned by delay in the carriage of passengers by air is limited by the Warsaw Convention or the Montreal Convention.  Where the Montreal Convention applies, the applicable limit of liability is 4,150 SDRs unless certain defenses specified by that Convention apply.  The Montreal Convention limit of liability applies to  carriage undertaken by Ghana International Airlines, Ltd.

Conditions of contract

1. As used in this contract/document: “ticket” means this passenger ticket and baggage check, or in the case of an electronic ticket this Itinerary/Receipt of which these conditions and the notices form part, “carriage” is equivalent to “transportation”, “carrier” means all air carriers that carry or undertake to carry the passenger or his/her baggage hereunder or perform any other service incidental to such air carriage, “electronic ticket” means the Itinerary/ Receipt issued by or on behalf of carrier, electronic coupons and, if applicable, a boarding document, “Montreal Convention” means the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed at Montreal,
28 May 1999, “SDR” means the composite unit of currency known as the Special Drawing Right that is the official unit of exchange of the International Monetary Fund, “Warsaw Convention” means, whichever may be applicable, the Convention of the Unification of Certain Rules Relating to International Carriage by Air signed at Warsaw 12th October 1929, or that Convention as amended at The Hague, 28th September 1955, or either of those instruments as amended by further instruments of international law.

2. Carriage hereunder is subject to the rules and limitations relating to liability established by the Warsaw Convention or the Montreal Convention unless such carriage is not “international carriage” as defined by one of those Conventions.

3. To the extent not in conflict with the foregoing carriage and other services performed by each carrier are subject to:
(i) provisions contained in the ticket; (ii) applicable tariffs; (iii) carriers’ conditions of carriage and related regulations which are made part hereof (and are available on application at the offices of carrier), except in transportation between a place in the United States or Canada and any place outside thereof to which tariffs in force in those countries apply.

4. Carrier’s name may be abbreviated in the ticket, the full name and its abbreviation being set forth in carrier’s tariff, conditions of carriage for passengers and baggage, regulations or timetables; carrier’s address shall be the airport of departure shown opposite the first abbreviation of carrier’s name in the ticket; the agreed stopping places are those places set forth in this ticket or as shown in carrier’s timetables as scheduled stopping places on the passenger’s route; carriage to be performed hereunder by several successive carriers is regarded as a single operation.

5. An air carrier issuing a ticket for carriage over the lines of another air carrier does so only as its Agent.

6. Any exclusion or limitation of liability of carrier shall apply to and be for the benefit of agents, servants and is used by carrier for carriage and its agents, servants and representatives.

7. Checked baggage will be delivered to bearer of the baggage check. In case of damage to baggage moving in international transportation complaint must be made in writing to carriers forthwith after discovery of damage and, at the latest, within seven days from receipt; in case of delay, complaint must be made within 21 days from date the baggage was delivered. See tariffs or conditions of carriage for passengers and baggage regarding non-international transportation.

8. This ticket is good for carriage for one year from date of issue, except as ticket, in carrier’s tariffs, conditions of carriage for passengers and baggage, or related regulations. The fare for carriage hereunder is subject to change prior to commencement of carriage. Carrier may refuse transportation if the applicable fare has not been paid.

9. Carrier undertakes to use its best efforts to carry the passenger and baggage with reasonable dispatch. Times shown in the timetables or elsewhere are not guaranteed and form no part of this contract. Carrier may without notice substitute alternate carriers or aircraft and may alter or omit stopping places shown on the ticket in case of necessity. Schedules are subject to change without notice. Carrier assumes no responsibility for making connections.

10. Passenger shall comply with Government travel requirements, present exit, entry and other required documents and arrive at airport by time fixed by carrier or, if no time of fixed, early enough to complete departure procedures.11. When the letters and numbers G0 are entered in the “carrier” box of the flight coupon(s) this denotes that the actual carrieris Ghana International Airlines, Ltd. or one of Ghana International Airlines, Ltd.’s code-share partners. Any other letter codes in this box denote another carrier. Details are available on request. Notice of government and airport imposed taxes, fees and charges. The price of this ticket may include taxes, fees and charges which are imposed on air transportation by government authorities and airports. They may represent a significant portion of the cost of air travel and are either included in the fare or shown separately in the “TAX/FEE/CHARGE” box(es) of this ticket. You may also be required to pay taxes, fees or charges not already collected.  Please Note: The price of your ticket may includes a Security, facilities and/or insurance charge. It is shown on your ticket in the tax, fee charge area as YQ, or if aggregated with other taxes, fees or charges, XT. 

Notice of Denied Boarding Compensation
Whilst Ghana International Airlines, Ltd. makes every effort to provide seats for which a confirmed reservation has been made, exceptionally airline flights may be overbooked. In these circumstances Ghana International Airlines, Ltd. will first ask for volunteers willing to give up their reservations in exchange for a payment or other compensation. If there are not enough volunteers then Ghana International Airlines, Ltd. may be obliged to deny boarding to other persons. Any person who is denied boarding on an overbooked flight while in possession of a ticket and other relevant travel documents for which the reservation has been confirmed and who presents himself or herself at check-in within the required minimum time, may be entitled to compensation under various international regulations and rules provided that he/she has complied with the carrier’s conditions of carriage for passengers and baggage. Passengers should note that for the purpose of denied boarding compensation, the required minimum time is 60 to 180 minutes depending upon the airport and that passenger presenting themselves at check-in less than 60 to 180 minutes depending on the airport before the scheduled departure time of a flight shall not be entitled to compensation. Details of compensation arrangements are available at the carrier’s ticket desks or check-in. 

Notice of incorporated terms of contract Air transportation, whether it is domestic or international (including domestic portions of international journeys), is subject to the individual terms of the transporting air carriers, which are herein incorporated by reference and made part of the contract of carriage. Other carriers on which you may be ticketed may have different conditions of carriage. International air transportation, including the carriers’ liability, may also be governed by applicable tariffs on file with the US and other governments and by the Warsaw Convention, as amended, or the Montreal Convention or its successor. Incorporated terms may include, but are not restricted to:

          1. Rules and limits on liability for personal injury or death.
2. Rules and limits on liability for baggage, including fragile or perishable goods, and               availability of excess valuation charge.
3. Claims restrictions, including time periods in which passengers must file a claim or               bring an action against the air carrier.
4. Rights of the air carrier to change terms of the contract.
5. Rules on reconfirmation of reservations, check-in times, and refusal to carry.
6. Rights of the air carrier and limits on liability for delay or failure to perform service,               including schedule changes, substitution of alternate air carriers or aircraft and               rerouting.

You can obtain additional information on items 1 through 6 above at any U.S. location where the transporting air carrier’s tickets are sold. You have the right to inspect the full text of each transporting air carrier’s conditions of carriage at its airport and city ticket offices. You also have the right, upon request, to receive free of charge the full text of the applicable terms/conditions of carriage incorporated by reference from each of the transporting air carriers. Information on ordering the full text of each air carrier’s terms/conditions of carriage is available at any U.S. location where the air carrier’s tickets are sold.

Reconfirmation notice. Some international carriers require reconfirmation of your reservations. Contact the transporting air carrier for the applicable requirements.Dangerous articles in baggage. For safety reasons, dangerous articles such as those listed below, must not be carried in passengers’ baggage. Compressed gases (deeply refrigerated, flammable, non-flammable and poisonous) such as butane, oxygen, liquid nitrogen,  aqualung cylinders. Corrosives such as acids, alkalis, mercury and wet cell batteries. Explosives, fireworks, flares, sparklers or other explosives. Flammable liquids and solids such as lighter fuel, matches, paints, thinner and fire-lighters. Radioactive materials. Brief-cases and attaché cases with installed alarm devices. Oxidizing materials such as bleaching powder, peroxides. Weapons such as disabling sprays e.g. tear gas, mace, pepper spray. Firearms and a limited quantity of ammunition may be carried subject to proper packaging etc – contact the airline in advance. Poisons and infectious substances such as insecticides, weed-killers and live virus materials. Other dangerous articles such as magnetized material, offensive or irritating materials. Many of these listed articles can be carried as air cargo provided they are packed in accordance with cargo regulations. (Further information is available on request). Medicines and toiletries in limited quantities which are necessary during the flight, such as hairsprays, perfumes and medicines containing alcohol may be carried.

Passengers traveling to or from the USA MUST be in possession of a Machine Readable Passport. These can generally be identified by two lines of computer code printed at the bottom of the page that contains the passport holder’s personal details. Travelers not in possession of machine readable passports will be required to apply for either B-1 (business) or B-2 (tourist) visa or apply for a new passport (this is regardless of whether your original is still valid). Baggage allowances and limitations
For travel to or from North America
     Check In Baggage Allowance

•Adult/Child baggage allowance – Two pieces of luggage per passenger, each weighing up        to 23kg (50lbs). When added together, the three dimensions of any piece of luggage must        not exceed 158cm (62in).

For travel to or from all other destinations 
     Check In Baggage Allowance

       • Economy class baggage allowance – Two pieces of luggage per passenger, weighing up        to 40kg (88lbs). When added together, the three dimensions of any piece of luggage must        not exceed 158cm (62in).

• Business class baggage allowance – Two pieces of luggage per passenger, weighing up to        50kg (110lbs). When added together, the three dimensions of any piece of luggage must        not exceed 158cm (62in).

Cabin Baggage Allowance

• Business Class: 2 bags 23x35x55cm (9x14x22in) OR 1 garment bag 20cm (8in) thick        when folded, PLUS 1 briefcase/laptop computer Total combined weight – 16kg/35lb,        maximum of 8kg/18lb per piece.

• Economy and Infants: 1 bag 23x35x55cm (9x14x22in) Total weight – 6kg/13lb.
Wheelchairs, crutches, baby carriages and items necessary for infant care during the flight        will be carried free over and above the baggage allowance. However baby carriages,        carrying baskets and wheelchairs will normally be carried in the hold and not in cabin.
During peak periods these limits may be strictly enforced and excess baggage may be        limited or prohibited. Please contact Ghana International Airlines, Ltd. in advance to        enquire about excess baggage to avoid disappointment.
